Welcome to BRDY Golf, the ultimate centralized digital platform for the modern golfer. By using our mobile applications, website, and related systems (collectively, the "Services"), you are entering into a binding legal agreement.

Note: If you do not agree to these Terms, our Privacy Policy, or our Community Standards (collectively, the "User Agreement"), please do not use our Services.

1. Eligibility and Access

To use BRDY Golf, you must meet the following criteria:

• Residency: You must be a legal resident of the 50 United States or the District of Columbia.
• Age: You must be at least 18 years of age (or the age of majority in your state of residence).
• Authority: You have the legal capacity to enter into this agreement and are not barred from receiving services under U.S. law.

2. Privacy and Data Handling

Your privacy is paramount. Our Privacy Policy outlines how we collect, store, and process your data. By using the Services, you consent to the collection and use of this information to provide the BRDY Golf experience, including live scoring updates and personalized gear recommendations.

3. User Content and License

"Content" includes profile data, WITB lists, tournament predictions, comments, and messages.

• Your Responsibility: You own the Content you create. You represent that you have all necessary rights to share it and that it complies with applicable laws.
• Private Content: Shared only with approved "Friends." We will not use Private Content for marketing without your explicit consent.
• Public Content: For any content shared globally (e.g., public predictions or WITB lists), you grant BRDY Golf a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, and distribute that content.
• Removal: We reserve the right to remove any Content that violates our Community Standards or infringes on third-party intellectual property.

4. Predictions, Sweepstakes, and Rewards

BRDY Golf offers engagement features including tournament predictions and sweepstakes.

• No Purchase Necessary: Participation in sweepstakes is subject to specific Official Rules provided at the time of entry.
• Skill-Based Predictions: Predictions are for entertainment and social engagement purposes. BRDY Golf is not a gambling platform.
• Compliance: You agree to comply with all local laws regarding digital contests and promotions.

5. Intellectual Property and Third Parties

• Our License to You: We grant you a personal, non-assignable, and non-exclusive license to use the BRDY Golf software for personal enjoyment.
• Third-Party Marks: All third-party trademarks, logos, and player headshots remain the property of their respective owners (e.g., PGA Tour, equipment manufacturers).
• No Endorsement: Use of these marks does not imply sponsorship or endorsement of BRDY Golf by those third parties.

6. Prohibited Conduct and Enforcement

We operate a "Three Strikes" policy:

• Strike 1 & 2: Warning and temporary suspension of posting privileges.
• Strike 3: Permanent account termination.

Note: We reserve the right to bypass this policy for severe violations, including illegal acts or targeted harassment.

7. Limitation of Liability

To the maximum extent permitted by law, BRDY Golf and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services. Our total liability for any claim shall not exceed $100 USD or the amount you paid us in the past six months, whichever is greater.

8. Governing Law and Dispute Resolution

• Jurisdiction: These Terms are governed by the laws of the State of Delaware.
• Venue: Any disputes arising from this agreement shall be litigated exclusively in the state or federal courts located in Delaware.
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in a class-action lawsuit.

9. Updates and Termination

• Changes: We may update this User Agreement. We will notify you via the app or email at least 30 days before significant changes take effect.
• Inactivity: Accounts inactive for more than 2 years may be deleted to protect user data and system resources.
• Self-Termination: You may delete your account at any time within the app settings.
