Welcome to BRDY Golf. These Terms of Service ("Terms") govern your access to and use of the BRDY Golf mobile applications (iOS and Android) and website (collectively, the "Service"), operated by BRDY Golf ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

IMPORTANT: These Terms contain an arbitration clause and class action waiver that affect your legal rights. Please read Section 12 carefully.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that:

• You meet the age requirement

• You have not been previously suspended or removed from the Service

BRDY Golf provides a comprehensive golf information platform that includes:

• Live Scores & Leaderboards: Real-time tournament scores and player standings across multiple golf tours
• News & Updates: Breaking news, articles, and updates from the golf world
• Player Profiles: Comprehensive player information, statistics, and rankings
• Tournament Information: Schedules, results, and details for professional golf tournaments
• Personalization: Ability to follow favorite players and customize your experience
• Predictions & Engagement: Tournament predictions and interactive features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

4. User Accounts

Account Registration

To access certain features of the Service, you must create an account. You may register using:

• Email and password
• Google account authentication
• Apple account authentication

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Providing accurate and complete registration information

You may not:

• Share your account credentials with others
• Create multiple accounts for fraudulent purposes
• Use another person's account without permission
• Create an account using false or misleading information

Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in harmful conduct.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for any illegal or unauthorized purpose

• Post or transmit spam, unsolicited messages, or promotional content
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated tools (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove, modify, or obscure any copyright, trademark, or proprietary notices
• Collect or harvest personal information about other users
• Post false, misleading, or fraudulent content
• Distribute viruses, malware, or other harmful code
• Use the Service for gambling or betting purposes
• Engage in any activity that could damage our reputation or business

The Service and its content, features, and functionality (including but not limited to information, software, text, displays, images, video, audio, design, selection, and arrangement) are owned by BRDY Golf, its licensors, or other content providers and are protected by:

• Access and use the Service for personal, non-commercial purposes
• Download and install the mobile applications on your devices
• View and interact with content as intended by the Service

This license does not include any right to:

• Resell or commercial use of the Service or content
• Derivative use of the Service or content
• Download or copy account information for other users
• Use of data mining, robots, or similar automated tools

Third-Party Content

The Service may display content from third parties, including news articles, scores, statistics, and player information. This content is the property of its respective owners. We make no representations or warranties regarding third-party content.

7. User-Generated Content

Your Content

You may contribute content to the Service, including:

• Tournament predictions
• Player favorites and preferences
• Profile information and photos
• Comments or feedback (if applicable)

License Grant

By submitting content to the Service, you grant BRDY Golf a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service.

Content Standards

You represent and warrant that your content:

• Does not violate any third-party rights
• Does not contain unlawful, defamatory, or obscene material
• Does not contain viruses or malicious code
• Complies with all applicable laws

Content Monitoring and Removal

We reserve the right, but are not obligated, to monitor, review, and remove any content that violates these Terms or is otherwise objectionable. We are not responsible for user-generated content.

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that defects will be corrected

Accuracy of Information

• The accuracy of scores, statistics, or player information
• Real-time availability of live updates
• The completeness of tournament data

No Professional Advice

The Service is for informational and entertainment purposes only. It does not constitute professional, financial, or betting advice. Any decisions you make based on information from the Service are at your own risk.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BRDY GOLF AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of or damage to property
• Personal injury or emotional distress
• Business interruption

This limitation applies whether the liability is based on contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless BRDY Golf and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your violation of any rights of another party
• Your violation of any applicable laws
• Content you submit or transmit through the Service

12. Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to contact us at legal@brdygolf.co to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

Binding Arbitration

If we cannot resolve a dispute informally, any legal dispute will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules. The arbitrator's decision will be final and binding.

Class Action Waiver

YOU AND BRDY GOLF AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Unless both you and BRDY Golf agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and content
• You will no longer have access to any data associated with your account
• Provisions that should survive termination will remain in effect

You may terminate your account at any time by deleting it through the app settings or contacting us.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Sending a notification through the app or via email
• Requiring you to accept the new Terms before continuing to use the Service

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. General Provisions

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and BRDY Golf regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, or government actions.

Apple App Store

If you access the Service through an iOS device, you acknowledge that:

• These Terms are between you and BRDY Golf, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for the app or its content
• Apple is a third-party beneficiary of these Terms
• You must comply with Apple's Terms of Service

Google Play Store

If you access the Service through an Android device, you acknowledge that:

• These Terms are between you and BRDY Golf, not Google
• Google has no obligation to provide maintenance or support
• Google is not responsible for the app or its content
• You must comply with Google Play's Terms of Service
